These Terms of Use govern your access to and use of the Falcon Racing América website (the "Site"). By browsing the Site or contacting us through it, you agree to these terms. If you do not agree, please do not use the Site.
1. Who we are
Falcon Racing América is the distributor of Falcon Racing rowing boats and parts for the Americas, and also offers boats from the Peisheng line. Falcon Racing and Peisheng boats are designed and manufactured by their respective manufacturers; Falcon Racing América is not the manufacturer.
2. Purpose of the Site
The Site is an informational catalog. It shows boat models, parts and accessories, photos, events and ways to contact us. No purchase is made through the Site: you cannot pay or place a binding order here.
3. Product information
We do our best to keep descriptions, specifications, measurements and photos accurate, but:
- Specifications (weights, lengths, crew weight ranges, materials, etc.) are provided by the manufacturers and may change without notice.
- Photos are illustrative. Colors, finishes, rigging and equipment of the boat you receive may differ.
- The availability of a model or part is not guaranteed until we confirm it in writing.
If a specification is decisive for your purchase, please ask us to confirm it before ordering.
4. Quotes and sales
Quote requests sent through the contact form, email or WhatsApp are not orders and do not oblige either party. Every sale is agreed separately with you in writing, including price, currency, payment method, production and delivery times, shipping, import duties, taxes and warranty. Those specific conditions prevail over these Terms.
Prices are not published on the Site. Any price we send you is valid for the period indicated in the quote.
5. Shipping, import and warranty
Shipping costs, customs procedures and import duties depend on the destination country and are detailed in each quote. Product warranties are those offered by the manufacturer and are explained to you before the sale is closed. Nothing in these Terms limits the rights you have under the consumer protection laws of your country.
6. Intellectual property
The Falcon Racing and Peisheng names and logos belong to their respective owners. The texts, photos, videos and design of the Site belong to Falcon Racing América or are used with permission. You may share links to the Site, but you may not copy, reproduce or use its content for commercial purposes without our written authorization.
Some photos show athletes and clubs at competitions. If you appear in a photo and want it removed, write to us and we will remove it.
7. Acceptable use
When using the Site, you agree not to:
- Send false information, spam or messages unrelated to our products through the contact form.
- Try to access, damage or overload the Site or the systems that host it.
- Collect content or data from the Site through automated means for commercial use.
8. Third-party links and services
The Site includes links and embedded content from third parties, such as WhatsApp, Instagram, YouTube and the official Falcon Racing website. We are not responsible for their content or their privacy practices; using them is subject to their own terms.
9. Limitation of liability
The Site is provided "as is". We do not guarantee that it will always be available or free of errors. To the extent permitted by law, Falcon Racing América is not liable for damages arising from the use of the Site or from decisions made based solely on its information, without a written confirmation from us.
10. Changes to these Terms
We may update these Terms at any time. The date at the top of this page shows the latest version. Continuing to use the Site after a change means you accept the updated Terms.
11. Applicable law
These Terms are governed by the laws of the Argentine Republic, without prejudice to the mandatory consumer protection rules of your country of residence.
